This document is the contract between you and Mindlet. It also serves as the end user licence agreement (EULA) for the application downloaded from the App Store and Google Play.
We wrote these terms to be readable. They remain legally binding: take the time to go through them, in particular section 4 on subscriptions and section 5 on cancellation.
1. Who we are, and what this document applies to
Mindlet is an artificial-intelligence-assisted learning service published by SAS MINDLET, whose registered office is in Aléria (Haute-Corse, France). All our contact details are on the legal notice page.
These terms apply:
- to the
mindlet.appwebsite; - to the
app.mindlet.appweb application; - to the Mindlet mobile applications for iOS and Android;
- to all paid subscriptions, whatever the channel through which they are taken out.
Together, these are referred to as “the Service”.
2. Purpose of the service
Mindlet turns content you provide (a PDF, a video, a course, an audio recording) into learning formats: review cards, quizzes, summaries, structured paths. The Service then schedules your reviews according to spaced repetition principles, and offers collaborative features.
The Service includes a free offer and paid plans described in section 4.
3. Acceptance, minimum age and account
3.1 Acceptance
Creating an account, or simply using the Service, constitutes full and complete acceptance of these terms. If you disagree with any of them, do not use the Service.
3.2 Minimum age
The Service is available from the age of 13. Under 13, an account can only be created and managed by a parent, from their own account.
We ask for your month and year of birth when you sign up. What this changes:
- Under 13: the account is created and managed by a parent. Learning is complete; features between members (friends, messages, challenges, publishing) are not available.
- Between 13 and 15: you can create your account and start reviewing immediately. Features between members remain closed until a holder of parental authority has given their consent, in accordance with article 45 of the French Data Protection Act (loi Informatique et Libertés); you send them the request from the application. They can then open or close these features whenever they wish.
- From 15: you decide on these features yourself.
- Purchases: reserved for adults.
If you are a minor, your legal representative must have read these terms.
Our commitments regarding the protection of minors are detailed on the child safety page.
3.3 Your account
You undertake to provide accurate information when creating your account and to keep it up to date. You are responsible for keeping your login credentials confidential and for any activity carried out from your account. Let us know without delay at support@mindlet.app if you suspect unauthorised access.
An account is personal. It may not be shared, lent or resold.
3.4 Suspension and termination by Mindlet
We may suspend or close an account in the event of a serious breach of these terms, in particular in the event of prohibited use described in section 8, fraud, or harm to the security of the Service. Except in an emergency or where required by law, we inform you beforehand and give you the opportunity to remedy the situation. If the account is closed for a reason not attributable to you, the part of the subscription already paid and not used is refunded to you.
4. Auto-renewable subscriptions
This section describes precisely how our paid subscriptions work. It is the most important section of the document.
4.1 The plans
Mindlet offers a permanent free plan, available without any payment, and four individual subscription plans, each available on a monthly or annual basis.
All plans give access to the same features. They differ only in their monthly allowance of éclats (section 4.2), their caps on collections and cards, the number of messages you can send to the assistant over a given period, and the number of pages of a website imported at once.
Prices on the web, including all taxes:
| Plan | Monthly | Annual, paid in one go | Éclats per month | Collections | Cards |
|---|---|---|---|---|---|
| Free | €0 | — | 400 | 3 | 100 |
| Spark | €5.99 | €59.88 (that is €4.99 a month) | 750 | 20 | 2,000 |
| Glow | €11.99 | €119.88 (that is €9.99 a month) | 1,500 | 250 | 10,000 |
| Nova | €23.99 | €239.88 (that is €19.99 a month) | 3,000 | Unlimited | Unlimited |
| Pulsar | €59 | €588 (that is €49 a month) | 7,500 | Unlimited | Unlimited |
Sub-collections and notes do not count towards the collection and card caps.
| Plan | Messages to the assistant, per 5-hour period | Messages to the assistant, per 7-day period | Pages of a website imported at once |
|---|---|---|---|
| Free | 20 | 120 | 15 |
| Spark | 60 | 600 | 25 |
| Glow | 150 | 1,500 | 40 |
| Nova | 300 | 3,000 | 50 |
| Pulsar | 600 | 6,000 | 50 |
A technical consumption limit over 24 hours also applies to exchanges with the assistant, in order to prevent abusive use.
A separate offer, Cosmos, is aimed at institutions and organisations. It can only be taken out on the web, on a monthly basis. Prices including all taxes:
- a base of €99.99 a month, which includes two creator seats;
- each additional creator seat is billed according to the total number of seats: €27 a month from 3 to 9 seats, €25 from 10 to 19 seats, €24 from 20 to 49 seats. The price of the tier reached applies to all additional seats. Beyond 49 seats, the offer is quoted on request;
- learners and observers are unlimited and free;
- an allowance of éclats shared between members: 12,000 éclats a month, plus 3,000 éclats per additional seat.
A reduction in the number of seats takes effect on the renewal date.
The details of each plan, the content and features provided during each subscription period, and the current price including all taxes, are displayed before any purchase: on the Service’s pricing page, and on the subscription screen itself. No payment is triggered unless that price has been shown to you and you have confirmed it.
Each subscription lasts one month or one year depending on the chosen frequency, starting from the date of purchase.
4.2 Éclats
The éclat (French for “spark” or “shard”) is the Service’s unit of account. It is consumed by actions that use artificial intelligence, for example: generating a course, a practice exam or a revision sheet, importing a document (counted per page) or an audio or video file (counted per minute), a voice conversation with the assistant (counted per minute). Written messages sent to the assistant do not consume éclats. When the application displays éclats, the cost of an action is shown to you before you launch it.
Reviewing never consumes éclats. Resuming a session, redoing a quiz, retaking an exam already generated or viewing your content remains free and unlimited, whatever your plan, including on the free plan.
Two kinds of éclats coexist, with different validity periods:
| Kind | Origin | Validity |
|---|---|---|
| Earned | Bonus of 200 éclats, offered once when the account is created | 45 days |
| Subscription | Monthly allowance of your plan or of the free plan | The current cycle and the following cycle |
Earned éclats are consumed before subscription éclats; within the same kind, those that expire first are consumed first.
The subscription allowance is granted for each monthly cycle, including for an annual subscription. It is granted the first time you use the Service during the cycle: a cycle during which you do not use the Service gives rise to no allowance. For the free plan, the cycle is the calendar month. A guest account, created with « Essayer sans compte » (Try without an account), has an allowance of 250 éclats.
No paid top-up of éclats is offered at present.
When your balance runs out, no amount is charged to you automatically: actions that consume éclats are simply paused until the next allowance, or until you choose another plan.
4.3 Different prices depending on the purchase channel
Prices on the App Store and Google Play are higher than the prices on the web, by about 17%. This is not an extra margin: the difference covers the commission Apple and Google take on each transaction made through their platforms.
As an indication, the target prices on the stores are as follows, including all taxes:
| Plan | Monthly | Annual |
|---|---|---|
| Spark | €6.99 | €68.99 |
| Glow | €13.99 | €139.99 |
| Nova | €27.99 | €279.99 |
| Pulsar | €68.99 | €679.99 |
The applicable price is always the one displayed by the channel where you subscribe, at the time you subscribe: on the App Store and Google Play, the price shown by the store prevails. The Cosmos offer is not available on the stores.
4.4 Automatic renewal
All our subscriptions renew automatically. In practice:
- your subscription is tacitly renewed at the end of each period, for an identical period, at the price then in force;
- on the web, it renews unless you have cancelled it before the end of the current period, and the renewal is charged on the renewal date;
- on the App Store and Google Play, it renews unless you turn off automatic renewal at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before the end of the current period.
4.5 Billing depending on the subscription channel
Purchase through the App Store (iOS). The amount is charged to your Apple account when the purchase is confirmed. The renewal is charged to the same account. Managing the subscription and turning off automatic renewal are done in your Apple account settings, after the purchase: Settings > your name > Subscriptions.
Purchase through Google Play (Android). The amount is charged to your Google account when the purchase is confirmed, then at each renewal. Managing the subscription is done in your Google Play account settings: Play Store > Payments and subscriptions > Subscriptions.
Purchase on the web. Payment is processed by our provider Stripe. The amount is charged to the payment method you saved, at subscription and then at each renewal. Management and cancellation are done directly from the application, as described in section 5.
Important point for mobile subscriptions. When the subscription was taken out through the App Store or Google Play, the payment relationship binds you to Apple or Google. Mindlet does not have the technical ability to cancel the subscription on your behalf: only the holder of the Apple or Google account can turn off automatic renewal from that account’s settings. We can help you with the process, but we cannot carry it out for you. Refund requests for these purchases are also handled by Apple or Google, under their respective terms.
4.6 Trial periods
At present, Mindlet offers no trial period, on any subscription channel: the permanent free plan plays that role, and a paid subscription is charged as soon as it is taken out. The provisions that follow would apply only to a trial actually offered in the future.
When a free trial period is offered, its length and the price charged at the end of it are shown before subscription. Unless cancelled at least 24 hours before the end of the trial, the subscription starts automatically and the first amount is charged. If you take out a paid subscription before the end of a trial in progress, the unused portion of the trial is lost.
4.7 Price changes
We may change our prices. Any change is notified to you at least 30 days before it takes effect, by email. It applies only from the following renewal period. If the new price does not suit you, you can cancel before that date: the initial price continues to apply until the end of the current period.
4.8 Information before renewal (annual subscriptions)
For annual subscriptions taken out on the web, we inform you by email of the deadline for opting out of renewal, no earlier than three months and no later than one month before the end of the current period, in accordance with article L215-1 of the French Consumer Code. If this information does not reach you within that time, you can end the contract free of charge at any time from the renewal date.
5. Cancelling your subscription
Cancelling is free, and possible at any time.
5.1 Subscription taken out on the web: cancel in a few clicks
In accordance with articles L215-1-1 and D215-1 to D215-4 of the French Consumer Code, a cancellation feature is permanently available, free of charge, directly from the Service interface. The application interface is in French; the labels below are quoted as they appear, with a translation:
- go to app.mindlet.app and sign in;
- open Réglages → Abonnement (Settings → Subscription), section Préférences de facturation (Billing preferences);
- click « Résilier votre contrat » (Cancel your contract). You reach the billing space of our payment provider Stripe, which shows your current subscription and its end date;
- confirm the cancellation of your subscription.
You then receive, by email, confirmation of your cancellation, the date on which it takes effect and its consequences.
Cancellation takes effect at the end of the period already paid for. You keep access to your plan’s features until that date, then your account automatically switches to the free offer. Your content is kept.
Cosmos offer. The owner of the organisation manages the subscription from the organisation’s space, Réglages (Settings) tab, Abonnement (Subscription) section, by clicking « Gérer l’abonnement » (Manage the subscription), which opens Stripe’s billing space.
5.2 Subscription taken out on the App Store or Google Play
Cancellation is done from your Apple or Google account settings, following the paths given in section 4.5. As explained above, we cannot trigger it on your behalf.
5.3 Cancelling is not deleting your account
These are two separate actions:
- Cancelling ends billing. Your account, your collections and your progress are kept, and you continue to use Mindlet for free.
- Deleting your account erases your account and the associated data. The deletion becomes final after 30 days; until then, you can cancel it by signing in again. The procedure is described on the account deletion page.
Requesting the deletion of your account cancels, without renewal, a subscription taken out on the web. It does not cancel a subscription taken out through the App Store or Google Play: remember to turn off automatic renewal with the platform concerned before deleting your account.
6. Right of withdrawal
6.1 The principle
If you are a consumer, you have 14 days from the conclusion of the contract to withdraw without having to give a reason, in accordance with articles L221-18 et seq. of the French Consumer Code.
To exercise it, simply send us an unambiguous statement at support@mindlet.app. The refund is made no later than 14 days after we receive your request, using the same means of payment as the one used for the purchase.
6.2 Its limit for digital content supplied immediately
Under article L221-28, 13° of the French Consumer Code, the right of withdrawal can no longer be exercised for digital content supplied without a physical medium whose performance has begun, where you have given your express prior consent to that performance before the end of the 14-day period, you have expressly waived your right of withdrawal, and Mindlet has provided you with confirmation of that consent on a durable medium.
At present, subscribing does not ask you for that consent or that waiver. Your right of withdrawal therefore remains intact for the 14 days following the subscription of a plan on the web.
For purchases made through the App Store or Google Play, refund requests follow Apple’s and Google’s procedures.
7. Intellectual property
7.1 What belongs to Mindlet
The Service, its code, its interface, its design, its trademark, its logos, its illustrations, its mascots and its algorithms are the exclusive property of SAS MINDLET and are protected by intellectual property law.
We grant you a personal, non-exclusive, non-transferable and revocable right to use the Service, for the duration of your use. This right does not allow you to copy, modify, decompile or redistribute the Service, or to extract elements from it to exploit them outside the Service.
7.2 What belongs to you
Your content remains yours. The documents you import, the notes you write and the collections you build remain your property. We claim no ownership rights over them.
7.3 The licence you grant us
For the Service to work, you grant us a limited, non-exclusive, free and revocable licence over the content you import, for the sole purpose of:
- storing it and giving it back to you;
- sending it to our artificial intelligence model providers in order to generate the cards, quizzes and summaries you request;
- displaying it to the people with whom you choose to share it.
This licence is strictly limited to providing the Service. It ends when you delete the content concerned or your account. We do not use your content to train artificial intelligence models.
You warrant that you hold the necessary rights to the content you import, or benefit from a legal exception allowing its use.
8. Acceptable use
You undertake not to use the Service to:
- import, generate or distribute content that is unlawful, violent, hateful, discriminatory, defamatory, or child sexual abuse material;
- infringe the rights of others, in particular copyright, privacy or image rights;
- harass, threaten or impersonate a third party;
- circumvent technical protections, or probe, overload or degrade the Service’s infrastructure;
- extract data massively by automated means, without our written permission;
- resell, sublicense or commercially exploit the Service without agreement;
- use the Service in a country under embargo within the meaning of applicable law, or if you appear on a list of prohibited parties.
Manifestly unlawful content can be reported to support@mindlet.app. We handle these reports diligently and remove the content concerned when its unlawful nature is established, in accordance with the French law on confidence in the digital economy and the European Digital Services Act.
9. The role of artificial intelligence
A large part of the content produced by Mindlet (cards, quizzes, summaries, review plans) is generated automatically by artificial intelligence models, from the documents you provide.
Three practical consequences follow:
- This content may contain errors. A model can misinterpret a document, produce an approximation or an inaccurate statement. We guarantee neither the accuracy, nor the completeness, nor the educational relevance of generated content.
- You remain responsible for your reviews. Mindlet is a learning aid. It replaces neither your courses, nor your textbooks, nor a teacher. Always check generated content against your reference sources, especially before an exam or in a professional context.
- Mindlet provides no advice. Generated content does not constitute medical, legal, financial or professional advice, whatever the subject of the imported document.
We use third-party artificial intelligence model providers, mainly Mistral AI, based in France. The list of these providers, the data they receive and the safeguards governing transfers outside the European Union are set out in sections 5 and 6 of our privacy policy.
10. Availability, maintenance and liability
10.1 Availability
We do our best to ensure the continuity of the Service, without committing to a contractual availability rate. The Service may be interrupted for maintenance, updates or security reasons. When the interruption is scheduled and significant, we inform you in advance.
The Service requires an internet connection and a compatible device, which you obtain and pay for yourself.
10.2 Changes to the Service
We develop Mindlet continuously. Features may be added, changed or removed. If a substantial feature of your paid plan were removed, you could cancel at no cost and obtain a refund of the unused portion.
10.3 Limitation of liability
We are liable under the conditions of ordinary law for direct damage resulting from a breach of our obligations.
We cannot be held liable for indirect damage, in particular the loss of data you did not back up elsewhere, loss of opportunity, failing an exam or a competitive examination, or harm resulting from content generated by artificial intelligence that you did not check.
For subscribers, and except in the case of gross negligence or wilful misconduct on our part, our liability is capped at the sums you paid us during the twelve months preceding the event giving rise to it.
Nothing in these terms excludes the legal guarantees of conformity and against hidden defects, or limits our liability in the event of bodily injury or intentional misconduct.
10.4 Legal guarantee of conformity
As a consumer, you benefit from the legal guarantee of conformity for digital content and services provided for in articles L224-25-12 et seq. of the French Consumer Code. In the event of a lack of conformity, it allows you to obtain the bringing into conformity of the Service or, failing that, a price reduction or termination of the contract.
11. Personal data
The processing of your personal data is not described here, so as not to duplicate information that must be kept up to date in one place. See our privacy policy: it details the data collected, its purposes, its retention periods, our processors and how to exercise your rights.
12. Provisions specific to the App Store
The following provisions apply only to the application downloaded from Apple’s App Store, and prevail over any contrary provision of these terms in the event of conflict.
- Acknowledgement. This agreement is concluded between you and SAS MINDLET only, and not with Apple. Mindlet, not Apple, is solely responsible for the application and its content.
- Scope of licence. The licence granted to you is a non-transferable licence to use the application on any Apple-branded product that you own or control, within the limits of the Usage Rules set out in Apple’s Media Services Terms and Conditions. The application may be accessed by other accounts associated with you through Family Sharing.
- Maintenance and support. Mindlet is solely responsible for maintenance and support relating to the application. Apple has no obligation in this respect.
- Warranty. Mindlet is solely responsible for any warranty, express or implied. If the application fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price, if any, of the application; to the extent permitted by law, Apple will have no other warranty obligation.
- Product claims. Mindlet, not Apple, is responsible for handling any claim by you or a third party relating to the application or your possession and use of it, in particular product liability claims, claims of failure to conform to any legal or regulatory requirement, and consumer protection claims.
- Intellectual property. In the event of a third-party claim that the application infringes that third party’s intellectual property rights, Mindlet, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on any United States government list of prohibited or restricted parties.
- Developer contact details. Any question, complaint or claim relating to the application may be addressed to SAS MINDLET, Hameau de Cateraggio, Lot Rumana, Entrée Lot 1, 20270 Aléria, France. support@mindlet.app, +33 6 98 19 09 18.
- Third-party terms. You agree to comply with the terms of the applicable third-party services when using the application.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. By accepting them, you acknowledge Apple’s right to enforce these terms against you as a third-party beneficiary.
13. Changes to these terms
We may change these terms, in particular to take account of legal or functional developments. Any substantial change is notified to you by email at least 30 days before it takes effect. If it does not suit you, you can cancel your subscription at no cost before that date. Continuing to use the Service after it takes effect constitutes acceptance.
The date of the last update appears at the top of this page.
14. Applicable law and dispute resolution
14.1 Applicable law
These terms are governed by French law. If you live in another Member State of the European Union, this clause does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence.
14.2 Prior complaint
If you run into a problem, first contact our support at support@mindlet.app. The vast majority of situations are resolved at this stage.
14.3 Cross-border disputes
If the dispute has a cross-border dimension within the European Union, the European Consumer Centre France can assist you free of charge.
14.4 Jurisdiction
Failing an amicable agreement, the dispute may be brought before the competent courts. If you are a consumer, you may refer it either to the court of the place where you lived when the contract was concluded, or to that of the place where the harmful event occurred, or to that of the registered office of SAS MINDLET. If you are acting in a professional capacity, exclusive jurisdiction is granted to the courts within whose jurisdiction the registered office of SAS MINDLET is located.
15. Miscellaneous
If any provision of these terms were held to be void or unenforceable, the other provisions would remain in full force. Mindlet’s failure to rely on a breach does not amount to a waiver of the right to rely on it later. You may not assign your rights under these terms without our written consent.
